| dc.description.abstract | Según Antonio Carrillo Flores, los derechos fundamentales de los pueblos, históricamente, han alcanzado o van alcanzado el reconocimiento no gracias a una conciencia pasiva, sino a una conciencia militante, en el sentido de luchar y asumir riesgos por una causa en que se creen. Ejemplos claros de esto son, las revoluciones americana o francesa, sin embargo, en estos procesos se luchaba por derechos muy específicos, como lo son la libertad, la igualdad o la abolición de la esclavitud. En la actualidad, observamos, un problema conceptual respecto a lo que se considera derechos fundamentales y eso, parece, haber acarreado problemas importantes. En este sentido vale la pena plantearnos las preguntas que menciona Carrillo Flores y trasladarlas al tema específico entorno a la protección penal de los animales, ¿Estamos dispuestos a luchar por el reconocimiento de los derechos de los animales?, ¿asumiremos los riesgos y las consecuencias de ello?, si la respuesta es afirmativa, esbozamos la siguiente, ¿resulta idónea la protección penal por parte del Estado? o ¿existen alternativas más efectivas? El reconocimiento de los animales como titulares de un bien jurídico penal, nos resulta contrario a los principios que guían el camino para un derecho penal funcional y respetuoso de los derechos humanos, por ello el siguiente estudio analiza, a la luz de estos principios, si resulta idónea la protección penal de los animales. | es_MX |

| dc.description.abstractEnglish | According to Carrillo Flores, the fundamental rights of people have historically been achieved—or are in the process of being achieved—not through passive awareness, but through a militant consciousness, in the sense of struggling and assuming risks for a cause in which they believe. Clear examples of this are the American and French revolutions. However, in these processes, the fight was for very specific rights, such as liberty, equality, or the abolition of slavery. Today, we observe a conceptual problem regarding what is considered fundamental rights, and this, it seems, has led to significant issues. In this regard, it is worth raising the questions posed by Carrillo Flores and applying them to the specific issue of criminal protection for animals: Are we willing to fight for the recognition of animal rights? Will we assume the risks and consequences that come with it? If the answer is yes, we then pose the following question: Is criminal protection by the State the appropriate path? Or are there more effective alternatives? Recognizing animals as holders of a legally protected interest in criminal law appears to contradict the principles that guide the path toward functional criminal justice system that respects human rights. Therefore, this study analyzes, considering these principles, whether criminal protection of animals is truly appropriate. | en |
