dc.description.abstractEl texto expone la evolución del concepto de bien jurídico como fundamento legitimante del derecho penal, revisando su aparente tensión con la tesis funcionalista de Günther Jakobs sobre la vigencia de la norma. Se presenta además el desarrollo histórico del bien jurídico desde Birnbaum y von Liszt, destacando su carácter normativo y su función de límite al legislador, para más tarde sintetizar la crítica funcionalista, según la cual el derecho penal no protege bienes sino la estabilidad comunicativa del sistema mediante la reafirmación de la norma quebrantada. De esta manera, se analizan estas objeciones, reconociendo sus aciertos pero subrayando sus límites: el bien jurídico no se agota en categorías naturalísticas, cumple una función preventiva y garantista, y no puede ser sustituido por una concepción autorreferencial de la norma; así la protección de bienes jurídicos y vigencia normativa no son funciones excluyentes, sino dimensiones complementarias del sistema penal. Finalmente, se concluye que el bien jurídico sigue siendo un concepto esencial para delimitar el injusto y fundamentar la intervención penal en un Estado democrático.es_MX

dc.description.abstractEnglishThe text examines the evolution of the concept of the legal interest as a legitimating foundation of criminal law and revisits its apparent tension with Günther Jakobs’s functionalist thesis on the validity of the norm. It also outlines the historical development of the legal interest from Birnbaum and von Liszt onward, emphasizing its normative character and its function as a limit on the legislature. The text then synthesizes the functionalist critique, according to which criminal law does not protect interests but rather the communicative stability of the system through the reaffirmation of the norm that has been breached. These objections are analyzed by recogni zing their merits while underscoring their limits: the legal interest cannot be reduced to naturalistic categories, it performs a preventive and rights-protective function, and it cannot be replaced by a self-referential conception of the norm. Thus, the protection of legal interests and the maintenance of normative validity are not mutually exclusive functions, but complementary dimensions of the criminal law system. The text concludes that the legal interest remains an essential concept for delimiting wrongdoing and grounding the exercise of penal authority in a democratic state.en
